Parents should have an estate plan which relates to the disposition of resources and property after death or during a crises. By making your estate plan clear you can reduce the potential for conflict and misunderstandings. Unforeseen events happen throughout life so you must prepare for them now. Some people just never get around to making specific legal arrangements to protect their kids and other family members. Other reasons frequently mentioned include: thinking that estate planning is not important for young adults, concern about costs of preparation of wills and important documents, believing that assets are not large enough to warrant transfer tax liability, and discomfort in discussing end-of-life issues with other family members.

A will is one element of an estate plan. While it is necessary to direct the distribution of assets after death, a majority of U.S. adults do not have a will. Many die without one. If you die without a will it is called dying “intestate” which means the state and federal regulations determine the distribution of assets. Proper legal preparation of a will provide for your kids and others according with a person’s desires for distribution of property.

Other legal documents that must be completed before a crises occurs that are part of an estate plan may include: Living will or Advanced Health Directives, General Durable Power of Attorney, Health- Care Power of Attorney.
Living Wills and health care power of attorney forms allow you to express your preferences for medical treatment should you become unable to communicate your wishes due to illness or permanent unconsciousness. They can also allow you to designate a person who can make end-of-life care decisions on your behalf.
Another common reason couples put off estate planning is that they can’t agree on who should get the kids should they both die. If you Let the legal system determine guardianship a family dispute could result over the kids or no one offering to take them.
In this particular circumstance, if you don’t decide then the courts will. This should motivate you to handle this situation.
